Terms of Service

These Terms form a binding agreement between you and Optim Enterprises BV. They are written in plain English; nothing here waives rights you have under mandatory Dutch or EU consumer protection law.
1. Who we are
"Tempo", "we", "us", "our" — Optim Enterprises BV, a besloten vennootschap incorporated in the Netherlands.

"You" — any individual who has created an account on Tempo.
2. Eligibility
You must be at least 18 years old to use Tempo. By creating an account you confirm you meet this requirement; we verify it during identity-verification. If we discover an account belongs to a minor we suspend it and delete the data.
You must not be a person legally barred from using a dating service in your jurisdiction, or a person we have previously banned for cause. We may decline service for any other lawful reason.
3. Your account
You are responsible for keeping your password confidential and for any activity on your account. Notify us immediately at [email protected] if you believe your account has been compromised.
You may only operate one account on Tempo. Operating multiple accounts to evade bans or to manipulate the match algorithm is grounds for permanent removal.
4. What Tempo does
Tempo is a deliberately slow dating service. We deliver a small number of matches per day based on values, beliefs, location, and preference signals. We do not promise that any match will lead to a relationship, a date, or even a reply. Matching is a service we provide on a best-effort basis using the data you give us; it is not a guarantee of any outcome.
Tempo uses limited algorithmic processing to suggest matches. Per our Privacy Policy §6, the suggestions are not "automated decisions producing legal effects" under GDPR Article 22. Account suspension decisions are always reviewed by a human moderator.
5. Your conduct
What you may and may not do on Tempo is governed by the Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of that policy can result in content removal, account suspension, or permanent ban, depending on severity.
6. Your content
Photos, messages, prompt answers, profile text, and anything else you publish on Tempo remain yours. You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, and display that content for the sole purpose of operating Tempo and providing the service to you and the matches you've authorised to see it. This licence ends when you delete the content or your account, except where we are required to retain something for legal or safety reasons (see Privacy Policy §5).
We do not sell your content. We do not show your content to advertisers. We do not use your photos to train AI models. We do not licence your content to third parties for any purpose other than operating Tempo.
You warrant that the content you upload is yours to publish — that you own it or have the right to publish it, that it does not infringe anyone else's rights, and that it is true (most importantly, that the photos you upload are of you).
7. Premium subscription
Tempo offers a paid Premium tier that unlocks features such as a second city, additional daily matches, and other comforts. Pricing is shown at checkout. Subscriptions auto-renew until cancelled in your account settings.
Right of withdrawal: as a consumer in the EU/EEA you have the right to withdraw from a paid subscription within 14 days of purchase, under Directive 2011/83/EU. However, by starting to use the Premium features immediately on purchase you expressly request that we begin performance before the 14-day period expires, and you acknowledge that doing so forfeits the right of withdrawal once the service has been fully performed. You may cancel future renewals at any time; we do not pro-rate refunds for a partially-used billing period.
8. Suspension and termination
We may suspend or terminate your account if you violate these Terms, the Acceptable Use Policy, or applicable law. We will tell you why, unless telling you would compromise an ongoing safety investigation or violate a legal obligation. You may appeal a moderation decision by emailing [email protected]; appeals are reviewed by a human within 14 days. This appeal right is part of our obligations under the EU Digital Services Act Article 20.
You may delete your account at any time from /me. Deletion is irreversible after the 30-day grace period.
9. Disclaimers
Tempo is provided "as is" and "as available". Within the limits allowed by mandatory Dutch and EU consumer law, we make no promises beyond those expressly stated in these Terms — in particular, no promise of uninterrupted service, no promise that any particular match will reply, and no promise about the truthfulness of what other users tell you.
Important safety note: we verify identity but we do not run criminal-background checks. Identity verification proves that the person on the other side is a real adult; it does not certify that they are kind, honest, single, or safe. Always meet a match for the first time in a public place, tell someone where you'll be, and trust your instincts.
10. Liability
Nothing in these Terms limits or excludes our liability where it cannot lawfully be limited under Dutch law — including liability for personal injury caused by our negligence, for fraud, or for intentional wrongdoing.
Subject to that, our total aggregate liability to you in connection with these Terms, whether in contract, tort, or otherwise, will not exceed the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) €100.
We are not liable for the conduct of other users, for content other users publish, or for what happens between you and a match outside Tempo. We are not liable for indirect or consequential loss (lost profits, lost relationships, lost time).
11. Reporting illegal content (DSA)
Under the EU Digital Services Act, you can notify us of content on Tempo that you believe is illegal under EU or member-state law. Use the in-app report flow (the "Report" button on any profile, message, or post), or email [email protected]. Your notice should describe the content, where it is, and why you believe it is illegal. We will confirm receipt, decide promptly, and tell you the outcome. Frivolous or abusive notices may result in restrictions on your account.

12. Copyright (DMCA / Article 17)
If you believe content on Tempo infringes your copyright, send a notice to [email protected] containing: identification of the work, the location of the infringing copy on Tempo, your contact details, a statement that you have a good-faith belief that the use is not authorised, a statement (under penalty of perjury) that the information is accurate and that you are the rights-holder or authorised to act, and your signature.
13. Changes to these Terms
We may update these Terms. If we make material changes — anything that meaningfully changes your rights or obligations — we will email you at least 30 days before they take effect and surface a banner in the app asking you to accept the new version on next sign-in. If you continue to use Tempo after the effective date you accept the change; if you don't accept, you should stop using Tempo and may delete your account.
14. Governing law and disputes
These Terms are governed by the laws of the Netherlands. The competent court for disputes is the District Court of Amsterdam, without prejudice to mandatory consumer-protection rules that allow you, as a consumer, to bring claims in the courts of your country of residence.
For online dispute resolution, EU consumers can also use the European Commission's ODR platform. Tempo is not currently signed up to a specific alternative-dispute-resolution body; if that changes we will list it here.
15. Miscellaneous
If a court holds any part of these Terms unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms; we may assign ours to an affiliate or in connection with a merger or acquisition, on notice to you and only where the assignee agrees to honour these Terms.
These Terms (together with the Privacy Policy and Acceptable Use Policy) are the entire agreement between you and us about Tempo.
